These Terms of Service ("Terms") govern your access to and use of the Virtue Mirage service ("Service"), provided by Virtue Creative Studios Pty Ltd ("Virtue Mirage," "we," "us," "our") in Sydney, Australia.
The Service is offered to two categories of user:
- Shoppers — individual customers who create or use a Digital Twin on a brand store running Virtue Mirage.
- Brands — businesses that have subscribed to a Virtue Mirage plan to deploy the Service on their own e-commerce storefront.
Different sections of these Terms apply to each. Please read the entire document before using the Service. By using the Service in any capacity you agree to be bound by these Terms.

1. Definitions
- Avatar means the AI-generated Digital Twin image that represents a Shopper after onboarding.
- Brand means a business that has subscribed to Virtue Mirage and deployed the Service on its e-commerce storefront.
- Cross-Brand Network means the opt-in feature that allows a Shopper's Avatar to be portable across multiple participating Brands.
- Render means a Try-On image produced by combining an Avatar with a product image.
- Shopper means an end-consumer using a Brand's storefront, including users of the Quick Try-On feature.
- Try-On means any rendered image of an Avatar wearing a product, including Bespoke Try-On, Quick Try-On, and Batch Pre-Render outputs.
2. Eligibility
You must be at least 18 years old to use the Service. Brands must be a duly registered business with legal authority to enter into these Terms. By using the Service you represent that you meet these requirements.
3. Account and access
Shoppers do not create a separate account — identification is via the email address associated with the Brand's storefront login (e.g. Shopify Customer Account). Brands sign in through Shopify Admin (for Shopify-hosted Brands) or via direct admin credentials issued by Virtue Mirage.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Shopper terms
4.1 Avatar creation
By uploading photos and submitting your physical attributes, you grant Virtue Mirage a non-exclusive, royalty-free, limited-purpose licence to use that data solely to generate, store, and display your Avatar and your Try-On Renders. You warrant that:
- The photos you upload are of you (the person creating the account) or you have the explicit consent of the person depicted.
- You have all rights necessary to upload the photos.
- The photos do not violate any law or contain any unlawful content.
4.2 Avatar ownership and lifespan
Your Avatar is a derivative AI artwork. You retain a personal, non-transferable right to use your Avatar within the Service. The Avatar is locked for the duration set by the Brand (3, 6, or 12 months — typically 12 months) and may be re-created after that period. You can request immediate permanent deletion at any time via hello@virtuemirage.com.au.
4.3 Quick Try-On
Quick Try-On is available to Shoppers without creating a full Avatar. Quick Try-On images are automatically deleted from our servers after 1 hour. You retain no ongoing storage of these images.
4.4 Marketing consent
Marketing communications from the Brand and from Virtue Mirage are opt-in only. You can unsubscribe via the email footer of any marketing message at any time.
5. Brand terms
5.1 Subscription
Brand subscriptions are billed monthly or annually at the rates shown on the pricing page (or as agreed in writing for Enterprise plans). Subscription includes a monthly allowance of AI generations; usage above the allowance is charged via top-up packs.
5.2 Avatar fees
An Avatar Fee applies per Shopper that creates a full Digital Twin on the Brand's store. The Avatar Fee is charged to the Brand and absorbed by the Brand — the Shopper is never charged. Avatar fees are:
- Lite, Bronze, Silver, Gold: A$1.00 per Avatar
- Enterprise: A$0.50 per Avatar (or as agreed in writing)
5.3 Brand obligations
The Brand agrees to:
- Provide accurate product imagery, metadata, and size matrix data to enable correct rendering.
- Display the Service in a manner consistent with the configuration options provided.
- Maintain its own privacy notice covering its use of the Service.
- Not attempt to misuse, reverse-engineer, or resell the Service.
- Honour Shopper data requests promptly when forwarded by Virtue Mirage.
5.4 Cross-Brand Network participation
Brand participation in the Cross-Brand Network is opt-in. Participating Brands agree to handle Shopper data under terms equivalent to our Privacy Policy and to allow Shoppers (with the Shopper's consent) to use their Avatar across other participating Brands.
6. Intellectual property
6.1 Virtue Mirage IP
The Service, software, prompts, models, processes, branding, and documentation are the property of Virtue Mirage and are licensed (not sold) to you. No rights are granted to copy, modify, distribute, or create derivative works of the Service except as expressly permitted in these Terms.
6.2 Brand product imagery
Product images and brand assets provided by the Brand remain the property of the Brand. Virtue Mirage holds a limited licence to use those images for the purpose of generating and delivering Renders.
6.3 Avatars and Renders
The Avatar is a derivative work owned jointly in respect of:
- The Shopper's likeness (Shopper's personal right);
- The AI model output (Virtue Mirage's right).
Renders combine the Avatar with Brand product imagery; the Brand may use Renders for the purpose of presenting personalised storefront experiences within the Service. Neither the Brand nor Virtue Mirage may sell, sub-licence, or use the Avatar or Renders for advertising or campaign material without the Shopper's separate, written consent.
7. AI-generated content
Virtue Mirage uses third-party AI models (currently provided by Google, via Vertex AI) to generate Avatars and Renders. Outputs are approximations and may contain inaccuracies, including but not limited to: imperfect fit representation, visual artefacts, lighting mismatches, or fabric-drape variation from the real garment. Renders are intended as a visual aid for purchase decisions and are not a guarantee of how the product will appear or fit in real life.
Image generation runs on Google's global endpoint, meaning individual requests may be processed in any Google data centre worldwide. Storage of avatars and renders is kept in a specific region (see the Privacy Policy for current details). Both sides are covered by the safeguards listed in the Privacy Policy.
We disclaim any reliance on Renders as a substitute for trying the product in person.
8. Acceptable use
You agree not to:
- Upload photos depicting another person without their explicit consent.
- Upload photos of minors.
- Use the Service to create defamatory, hateful, harassing, sexually explicit, or otherwise unlawful content.
- Attempt to extract, reverse-engineer, or replicate the AI models or rendering pipeline.
- Attempt to bypass rate limits, billing controls, or access controls.
- Use the Service in a way that interferes with other users' access.
- Resell or sublicence the Service.
We reserve the right to suspend or terminate any account that violates these provisions.
9. Payment and billing
Brand subscriptions are billed via either Shopify Billing (for Shopify-installed Brands) or Stripe (for direct Brands), in the currency shown on the pricing page (Australian Dollars unless otherwise agreed). Subscriptions renew automatically. You can cancel at any time via your Brand dashboard; cancellation takes effect at the end of the current billing period.
All fees are exclusive of GST and applicable taxes unless explicitly stated.
10. Term and termination
These Terms remain in effect for as long as you use the Service. Either party may terminate at any time:
- By a Shopper — by requesting Avatar deletion at any time.
- By a Brand — by cancelling the subscription via the Brand dashboard.
- By Virtue Mirage — at our discretion, for breach of these Terms or for technical, legal, or commercial reasons (with reasonable notice for paying Brands).
On termination, we will delete Avatars, Renders, and account data within 30 days, except where retention is required by law.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that Renders will be accurate or fault-free.
Where any non-excludable consumer guarantee applies under the Australian Consumer Law, our liability is limited (at our option) to re-supply of the Service or refund of fees paid for the Service.
12. Limitation of liability
To the maximum extent permitted by law, in no event shall Virtue Mirage (or its officers, employees, contractors, or affiliates) be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, loss of revenue, loss of data, or loss of goodwill, arising out of or in connection with the Service.
Our total aggregate liability arising out of or relating to the Service in any 12-month period will not exceed the greater of: (a) the fees paid by the Brand (or A$100 for a Shopper) in that period, or (b) A$500.
13. Indemnity
You agree to indemnify and hold harmless Virtue Mirage from and against any third-party claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms;
- Your unauthorised use of the Service;
- For Shoppers — uploading photos of a third party without consent;
- For Brands — your use of Renders in contexts outside the Service (e.g. for marketing campaigns) without Shopper consent.
14. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales. Before commencing any litigation, the parties will attempt to resolve disputes in good faith via direct negotiation for at least 30 days.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified to active Brands by email at least 30 days before they take effect, and to Shoppers by in-product notice. Continued use after the effective date constitutes acceptance.
